PROSPECTS: Prolonged delay
BACKGROUND: The project would be a dry mill corn processing plant focusing on Ethanol and distiller grains, processing 53,000 bushels+ of corn per day. In November 2008, the Minnesota Pollution Control Agency (MPCA) deemed the plant had no potential for significant environmental effects and that an Environmental Impact Statement (EIS) was not needed.
Eyota residents complained that the plant would bring unwanted traffic, noise, odors, and air and water pollution.
The Olmsted County Concerned Citizens group filed a lawsuit in district court, challenging the MPCA’s decision not to require an EIS, arguing there are unanswered questions that could affect the MPCA’s decision. The district court dismissed the lawsuit.
The citizens group appealed that decision in March 2010. In September 2010, Minnesota Court of Appeals heard the case. The decision from the court is still pending.
