BACKGROUND: LS Power submitted an application to the Colorado Department of Public Health and Environment in November 2006 to build the 600 MW coal-fired power plant in Morgan County. On January 7, 2008, LS Power withdrew its permit application for the High Plains Energy Station from the Colorado Department of Public Health and Environment. LS Power had pursued a partnership with Dynegy but citing a difficult credit market and steep regulatory obstacles, Dynegy pulled out of the joint venture. Opponents targeted the plant as part of a nationwide effort to stop the use of coal for energy due to CO2 emissions.
