OPPOSITION: Sierra Club
BACKGROUND: In June 2006 the developer proposed a 744 megawatt expansion of its existing Limestone facility at a cost of over $1 billion. A draft air permit was issued in October 2007. In November Sierra Club and others, including the Environmental Defense Fund (EDF), moved to block construction. However, in August 2008 the developer, EDF, and certain other opponents reached an agreement for emissions reductions in exchange for an end to their opposition to the program. Sierra Club, however, was not party to this agreement and continued its efforts to block construction. A final permit was issued in December 2009. In March 2010 Sierra Club sued in State court to block construction claiming the permit failed to properly control either hazardous air pollutants or CO2. This suit is pending.
