BACKGROUND: The $1 billion, 660 mega-watt coal-burning power plant would have been located 55 miles south of Chicago. Indeck received an air permit in 2003, in addition to a $50 million subsidy from the State of Illinois. The Sierra Club filed a lawsuit against Indeck questioning their air permit. In September 2006, the U.S. EPA's Environmental Appeals Board overturned the air permit, stating the project lacked emissions control requirements and environmental impact assessments. In 2008, Indeck declined to renew the option for the property the company intended to use for the plant, indicating that it did not intend to pursue the project further.
